ABA licensure by state

Do you need a license to practice ABA in New Hampshire? What New Hampshire law says

The short answer

We found no New Hampshire law that licenses behavior analysts in the official texts we read, and no behavior analyst board on the state's list of licensing boards. The only mention of the Behavior Analyst Certification Board (BACB) in what we read is an insurance coverage rule, RSA 417-E:2. We did not check pending bills or the state's administrative rules. Confirm with the New Hampshire Office of Professional Licensure and Certification (OPLC) before you rely on this.

What we found

On October 30, 2026, we read OPLC's "Find a Board" list. OPLC supports "more than 54 professional licensing boards, commissions and councils." The list includes Psychologists, Mental Health Practice, Occupational Therapists and Speech Language Pathologists Hearing Care Providers. It has no behavior analyst board.

We then read the table of contents of RSA Title XXX, Occupations and Professions, and searched it for "behavior," "analy" and "autism." None appears. We also read the two chapters closest to this work, RSA 330-A (Mental Health Practice) and RSA 329-B (Psychologists). Neither sets up a behavior analyst license.

RSA 329-B does mention the field. Its definition of "Psychology practice by a licensed psychologist" includes:

"(c) Counseling, consultation, psychoanalysis, psychotherapy, hypnosis, biofeedback, and behavior analysis and therapy;"

RSA 329-B:17, I says: "Except as provided in RSA 329-B:28, it shall be unlawful for any person to be engaged in psychology, licensed school psychology-doctoral, or licensed school psychology-specialist practice unless that person is licensed by the board or working under the direct supervision of a person licensed by the board." The chapter does not say whether behavior analysis by someone who is not a psychologist is psychology practice, and its list of exempted persons (RSA 329-B:28) does not name behavior analysts. Ask OPLC how it applies to your work if you are not a licensed psychologist.

We did not search pending bills or the New Hampshire Code of Administrative Rules.

What New Hampshire does have

New Hampshire names the BACB in its insurance law. For coverage of autism treatment, RSA 417-E:2, I(a) includes:

"(a) Professional services and treatment programs, including applied behavioral analysis, necessary to produce socially significant improvements in human behavior or to prevent loss of attained skill or function. To be eligible for coverage, applied behavior analysis must be provided by a person professionally certified by the national Behavior Analyst Certification Board or performed under the supervision of a person professionally certified by the national Behavior Analyst Certification Board."

This is a condition of insurance coverage. It is not a license.

Training the staff you supervise

If you run a program in New Hampshire and need new technicians or aides trained in the basics, this is what our Intro to ABA Level 1 course covers.

The Intro to ABA Level 1 course teaches methods and techniques of Applied Behavior Analysis (ABA) for parents and caregivers, teachers, paraprofessionals and behavior technicians who work with a child every day. Topics include what autism is, what ABA is, pairing, errorless teaching and prompting, and active student responding. Complete the course and pass its 40-question final exam with a score of at least 80%. Completing this course earns a Special Learning certificate of completion. That certificate is not a continuing education (CE) certificate. It is basic training in ABA methods for daily practice, not a professional credential. It is not the 40-hour training required for the RBT credential. We do not claim New Hampshire state approval or continuing education credit for this course.
