What your state requires of ABA employers

Sexual harassment prevention is an employer responsibility. These summaries cover selected state and local training rules; they are not a complete list of every duty or jurisdiction. Coverage depends on where employees work, their roles and the applicable headcount rules.

California

Employers with five or more employees must provide at least two hours of sexual harassment prevention training to California supervisors and at least one hour to California nonsupervisory employees, every two years. Online e-learning must give employees a way to contact a qualified trainer who can answer questions within two business days. California Civil Rights Department requirements.

New York

Every employer, regardless of size, must provide annual, interactive sexual harassment prevention training to employees working in New York. A video alone is not interactive; use the state's guidance for the additional interactive component. New York Department of Labor training guidance.

New York City

The city's training rules cover employers with 15 or more employees and employers with one or more domestic workers. Covered employers must retain training records for three years. The city explains which workers must train and how to count employees. New York City coverage rules; training records.

Illinois

Employers with employees working in Illinois must provide sexual harassment prevention training annually. Illinois Department of Human Rights requirements.

Delaware

Employers with 50 or more employees in Delaware must provide interactive sexual harassment prevention training to covered employees within one year of hire and every two years after that. Supervisors need additional training on their responsibilities. 19 Del. C. §711A.

Maine

In workplaces with 15 or more employees, new employees must receive sexual harassment prevention training within one year of starting work. Supervisors and managers require additional training on their responsibilities. 26 M.R.S. §807.

These are employer obligations, not a statement that a Special Learning course completes every requirement. Check the cited authority for current coverage, timing, content and recordkeeping details before choosing training.

State rules for the ABA staff you hire

Every state sets its own rules, if any, for the people an ABA agency hires: who may deliver services, what training they need, how much supervision, and which credential the state recognizes. Some states set no training hours at all, and many of the rules come from the state's Medicaid program and apply to the services it pays for. We read each state's laws, regulations and Medicaid manuals where we could reach them, and wrote down what we found, with the source it comes from and the date we checked. Where a rule could not be confirmed at a state source, the page says so instead of guessing.

Pick your state. Each page lists the rules we found, their citations, and, where we found one, a recent change. The pages are general information from the sources each page names, not legal advice, and not a statement about whether any training fits a state's requirement; confirm with the state before you act on them.
